This Privacy Policy describes how we collect, use, process, and disclose personal information of consumers. This Privacy Policy applies to the website located at https://www.sikahealth.com/ (the “Site”), [the software applications developed and distributed by Sika] and certain services available in connection with those (collectively, “Services”).  This Policy covers your (“you”, “your,” and/or “users”) use of the Services as well as other information you may share with our team by email or phone.

What is Sika?

Sika Health provides a platform that equips merchants to seamlessly accept their customers' FSA and HSA funds as a payment method at checkout. When we use “Sika,” “we” “us,” and/or “our” in this policy, we mean Sika Health, Inc. and its affiliates..

We value your privacy. This policy explains how we collect, store, secure, and use personal information in delivering the Services. Please carefully read the full Privacy Policy below, together with our Terms of Service, to fully understand our data handling practices and your rights and obligations when using the Services. We want to summarize a few key points up front:

  • Information you share with Sika is kept confidential and shared only with infrastructure providers who offer a confidentiality promise and critical security protections, and only to the extent necessary for its software infrastructure to operate.
  • Sika will NEVER sell your personal information or exchange it with a third party for anything of value.
  • Sika will use your information solely to provide services to you or with your consent.
  • You can update your information on, or terminate your information from our datastores by emailing us anytime.
  • Sika may collect data about your interactions with the Site on an anonymised, aggregate basis for its business functions, but does so in a way that does not allow you to be individually identified. 
  • You can reach us at support@sikahealth.comto update or delete your account information anytime.

Privacy Policy

The scope of this Privacy Policy covers your use of the Services.  It also describes the choices available to you regarding our use of your personal information.  This Privacy Policy is incorporated into Terms, below, and by using the Service you consent to the data handling practices described here. 

Data Sika Collects

When you contact us through the Site, we collect your email and message contents. If you choose to contact us through our Site, we collect these inputs into our contact form (“Contact Form Info”) and use them to reply to and engage with you.

We do not use cookies or web beacons to collect data from Site users.

When you use the Services, we also collect the following “Services Info”:

  • From the merchant who offers the product you are purchasing using you FSA/HSA account:
  • Your name
  • Your (billing) address
  • Your email 
  • Your phone number 
  • Details about your purchase info (item name, price, quantity)
  • As you pay with Sika, we may use an integration with a PCI-DSS compliant payment processor to collect and process your payment, which payment processor is subject to change. If Sika uses a third party payment processor, you will supply personal details and card information directly to the payment processor through a secure interface operated by that processor and Sika will not collect or store such details, which will be secured and kept confidential by the third party processor under contract with us. However, your billing details, such as your payment card number provided to Stripe are handled and secured exclusively by Stripe. Stripe returns a token to Sika indicating your payment.
  • If you choose to request that Sika help you create documentation to support your use of FSA/HSA funds for products that are not pre-certified as FSA/HSA eligible, we will also collect descriptions of the health needs for which you plan to use the product and any additional contact information you choose to supply (“Application Info”). We may or may not offer authenticated access to this service.

We refer to personally-identifiable information contained in Services Info and Contact Form Info collectively in this policy as “Personal Data.”

How Sika Uses Your Data

We use your Personal Info to reply to your Contact Request(s) and otherwise deliver Services to you as you request. We do not sell your Personal Data.

In addition, we use Personal Data in the course of running analytics, maintenance, and other related activities on the Services in order to enhance and improve the Services over time. 

In the case of Application Info, we use your info to generate appropriate documentation for you as a part of the Services..

We may analyze all or a large number of users’ Personal Data in aggregate, de-identified form in order to develop, analyze, and improve our Services and develop new features.

How Sika shares data

We do not share your Personal Information other than as directly described in this Policy. We never sell Personal Data about our users.

The main ways that Sika shares data are:

  1. Affiliates. We may share information with other entities who are under common control with us, or if we are exploring a merger, acquisition, or sale of assets, we’ll continue to ensure the confidentiality of your personal information and give affected users notice before personal information is transferred or becomes subject to a different privacy policy.
  2. Vendors. Consultants and companies that provide services to us related to the Service. For example, members of our team working as independent contractors who are under confidentiality agreements with us, or Stripe as a payment processing solution. You can review Stripe’s privacy practices here.
  3. Infrastructure and Analytics. We provide personal information to our affiliates and other trusted businesses or persons to process it for us, based on our instructions and in compliance with this Privacy Policy and any other appropriate confidentiality and security measures.  For example, we use hosting, cloud storage, code repository, customer support augmentation, and other similar third party services in the course of providing services to you, and share Personal Data to receive those services. We may share de-identified and/or aggregate information publicly and with our partners — like publishers, advertisers, developers, or rights holders. For example, we share information publicly to show trends about the use of FSA?HSA payments generally. We also allow specific partners to collect information from your browser or device for advertising and measurement purposes using their own cookies or similar technologies.
  4. Compliance with Law. We will share personal information outside of Sika if we have a good-faith belief that access, use, preservation, or disclosure of the information is reasonably necessary to: 
  1. Comply with any applicable law, regulation, legal process, or enforceable governmental request
  2. Enforce applicable Terms of Service or other contracts, including investigation of potential violations.
  3. Detect, prevent, or otherwise address fraud, security, or technical issues, or to protect the safety and security of our customers and users.

Our employees and contractors may have access to our software infrastructure and the data contained therein in the course of their employment or provision of services to us. We ensure that any such individuals are bound by contractual commitments to keep information confidential and secure, and also limit their access to our systems to that access which is necessary to perform their particular role.

How Sika Secures Data

All of the data transmitted to Sika from a merchant or from and individual purchaser is encrypted in transit and at rest, and is stored solely for the purpose of providing the Services. We will delete any Personal Data related to a particular merchant from our systems upon the request of that merchant, other than de-identified data that does not identify an individual user.

Unfortunately, no data transmission over the internet is guaranteed to be 100% secure and we therefore cannot guarantee the security of information you transmit to or from our Services or through electronic means in the source of receiving the Services, and you provide this information to us over the internet at your own risk. ACCORDINGLY, WE DISCLAIM LIABILITY FOR THE THEFT, LOSS, OR INTERCEPTION OF, OR UNAUTHORIZED ACCESS OR DAMAGE TO, YOUR PERSONAL DATA OR COMMUNICATIONS INTENDED FOR SIKA DURING TRANSMISSION OVER THE INTERNET. YOU ACKNOWLEDGE THAT YOU UNDERSTAND AND ASSUME THESE RISKS.

  • Request the removal of your Personal Data from our records. Please note that we are unable to delete transaction or other electronic logs or records created from Personal Data that are anonymized and de-identified, as we can no longer associate them with you.
  • Update and/or modify your Personal Data
  • Ask questions about how we protect your privacy and secure your information, and/or about this policy and our Terms
  • To let us know if you suspect someone else has been impersonating you in communications with Sika
  • Or if you have any other concerns whatsoever about your privacy and security
How We Update this Policy

Sika believes that you should have clear, comprehensible notice of any changes to our privacy practices following your submission of any personal information to us. For this reason, if we plan to make material changes to this Policy, we will email all of our users and offer them the opportunity to opt-out of the updated privacy practices and remove all of their information from our systems before the update takes effect. For significant changes, as determined in our sole discretion, we will present a notice to users if we have an opportunity to do so.
